When business deductions are refused, first distinguish whether the Tax Administration disputes your entrepreneurial status, the hours test or a condition for a particular deduction. Chamber of Commerce registration and a timesheet answer different questions. Identify each corrected item and the reason for each tax year. This guide helps prepare the substantive evidence. A formal response to an assessment or decision also requires the correct procedure. For a substantial correction, evidence dispute or penalty, a tax lawyer can assess your position alongside the numerical review.

1. Identify the deduction and disputed tax year
Business deductions encompass several items, including the self-employed deduction, start-up deduction, assisting-partner deduction and cessation deduction. Their conditions differ. Locate the exact field in your return and the correction in the letter or assessment. Record the tax year, amount claimed, amount granted and reason for the difference. Saying that all entrepreneurial benefits were removed does not yet allow a focused assessment.
An assessment for an earlier year cannot be checked solely against today's amounts. Keep the return version and guidance used for that year. Ask whether the dispute concerns entrepreneurial status, hours worked, an additional start-up condition or carrying forward a deduction because profits were insufficient. Correcting an accounting error is a different assignment from lodging a legal objection to a reasoned refusal.
2. Assess entrepreneurial status for income tax separately
Chamber of Commerce registration or filing VAT returns does not automatically prove entrepreneurial status for income tax. The Tax Administration mentions independence, expected profit, clients, investments and business risk, among other factors. Examine how these relate in your own activities. A trading name or the word self-employed in a contract cannot alone establish entitlement.
Collect assignments, invoices, investment records, client acquisition and payment-risk information. Explain unfavourable facts too, such as few clients or prolonged losses. Identify connected activities and those potentially assessed separately. Low turnover does not make every activity a hobby without examining the file; conversely, much time spent on an activity without realistic profit prospects does not automatically make it a business.
3. Apply the correct hours conditions without proportional reduction
For the self-employed deduction and certain others, you generally need at least 1,225 hours in the calendar year spent on your business or businesses. The Tax Administration usually also requires more time on the business than on other work. Anyone who was not an entrepreneur in at least one of the preceding five years need not satisfy that second condition. The 1,225-hour requirement remains.
Starting halfway through the year or stopping early does not reduce this annual threshold proportionally. Official guidance also describes special pregnancy rules and a separate reduced hours test for the disability-related start-up deduction. Have their applicability assessed specifically. A disability benefit does not confer entitlement to every business deduction without the other conditions.
4. Substantiate actual work with identifiable sources
Billable hours are not the only hours that may count. Preparing quotations, administration and work on the business website may also be business work. Merely being available without working does not count according to the Tax Administration. For each activity type, list date, duration, business purpose and evidence. Check consistency between calendars, correspondence, assignments and invoices.
Do not repair an incomplete record by retrospectively entering identical weekly hours as if recorded at the time. Clearly label a reconstruction and identify sources and uncertainties. Avoid double counting travel, simultaneous projects or employment. In partnerships with connected persons, supporting work may be excluded; for family businesses, therefore ask about more than the total.
5. Separate start-up history from deductions available for carry-forward
The start-up deduction is not a general bonus for everyone recently registered. Official guidance for 2026 links it to previous years of entrepreneurship and prior use of the self-employed deduction. Collect older returns, assessments and corrections too. A new commercial register number after a change does not independently determine how tax entrepreneurial history is assessed.
Low profit may prevent full use of the self-employed deduction in that year. The Tax Administration describes establishing and later offsetting unused self-employed deductions under separate conditions and decisions. This differs from refusal for insufficient hours. Establish exactly which decision is missing or allegedly incorrect; do not add an old balance again as a new deduction without checking.
6. Choose your response according to the document received
For an information request, prepare a focused explanation with evidence for each disputed condition. For an established assessment or separate decision, also monitor the correct objection procedure and response date. A discussion with your bookkeeper or a letter adding hours does not automatically replace the required objection. State the current stage immediately when seeking help.
Ask which original data the Tax Administration uses and address the actual reason for correction. Referring to many clients does not answer an hours objection, while a timesheet alone does not resolve independence. Give your adviser earlier correspondence and deadlines too. An additional penalty or formal information decision requires a separate legal assessment alongside recalculating the deduction.
7. Fictional example: starting alongside employment
A designer starts in July while employed. His return claims the self-employed deduction because he halved the annual hours minimum. Following a Tax Administration question, he discovers that availability was also recorded as work. His assignments and business expenses do suggest genuine business activities. This example is fictional and does not determine his ultimate entrepreneurial status.
Preparation therefore separates entrepreneurial status, the annual minimum that cannot be reduced, and hours actually worked. The designer provides an honest, supported reconstruction and has available deductions examined. He invents no extra hours to preserve the earlier amount. The bookkeeper checks the calculation; if tax classification is disputed or proceedings loom, a tax lawyer can assess the legal position.
8. Checklist for bookkeeper and tax lawyer
Request a division of work matching the obstacle. A bookkeeper can examine reconciliation between figures and returns; a tax lawyer can assess disputed classification, evidence, penalties or legal remedies. Record which year and decision the assignment covers and who acts on time. A general intake does not mean all ongoing tax deadlines have been taken over.
After assessment, keep the corrected calculation and evidence alongside the original version. Record the adjusted items and remaining disputes. Business deductions are not a subsidy paid directly, and the deduction amount is not the tax saving. This preparation guarantees no deduction; it identifies the condition and decision that actually require substantiation.

Frequently asked questions
Does my VAT number prove entitlement to the self-employed deduction?
No. Entrepreneurial status for VAT and income tax involve different tests. The deduction's specific conditions must also be examined.
May I halve 1,225 hours if I start in July?
No. The ordinary calendar-year hours minimum is not reduced proportionally. Have any special arrangements checked separately.
Do only hours supported by a customer invoice count?
No. Actual indirect business work can also count. Availability without work does not, and the time spent must be plausible.
Is a deduction unused because of low profit the same as a refused deduction?
Not necessarily. Unused self-employed deductions have their own determination and possible later offsetting. Read the precise decision and conditions.
