When the Belastingdienst imposes attachment, first establish which measure has been taken and which debt it is collecting. Wage attachment, a claim against a bank account and attachment of goods do not operate in the same way. Check the documents and any protected amounts, and have disputed enforcement assessed quickly. A tax lawyer can identify the correct legal route and any necessary urgent step. An objection to the tax assessment does not automatically resolve every collection measure. This guide concerns assessment after attachment has been imposed or specifically announced; the earlier enforcement-order stage is covered separately.

1. Establish what has actually been affected
Read the notice from the tax bailiff, bank, employer or benefits agency. Record the reference, the assessment concerned and what the document says is being withheld or frozen. The Belastingdienst distinguishes measures including a wage claim (loonvordering), payment claim (betalingsvordering) and government claim (overheidsvordering). Simply saying that your account is blocked does not yet give the adviser the information needed about the statutory measure and appropriate response.
Request missing documents from the appropriate party and put the enforcement date at the top. For attachment of goods, their description and any sale date matter. A general tax letter without the corresponding attachment document may give an incomplete picture. Also specify whether your personal assets or those of a business are involved. Entitlement and liability can then raise further questions that an administrative assumption cannot resolve.
2. Compare the debt, payments and earlier collection arrangements
Find the assessment, demand and enforcement order and create a timeline. Include all payments, credits and arrangements with evidence. A payment might, for example, have been processed under another reference, or an approved deferral might cover a different amount. Check not merely whether you have ever made contact, but exactly what was requested and confirmed in writing.
The Belastingdienst explains that collection has its own limitation period, which can be extended. Do not therefore use the date of an old assessment as proof that no further measure is permitted without examining the file. A lawyer can assess the period using information about interruption or extension. The age of the tax year on the merits and the continued availability of collection powers are different questions.
3. For income, check the protected earnings threshold
Official guidance says that attachment of income must leave enough for basic living costs. The protected earnings threshold, beslagvrije voet, is not simply one fixed amount for everyone. Check its calculation and the data used. Keep wage or benefit statements and relevant information about your personal circumstances. Have specific inaccuracies assessed rather than merely writing that the deduction feels too high.
The Belastingdienst refers to tools for checking the calculation and a separate route for an incorrect amount. Report an error immediately following the designated instructions and keep the response. This guide does not calculate an individual protected amount or guarantee reimbursement. It is nevertheless important that the income, measure and data used correspond before anyone concludes that all deductions complied with the rules.
4. Distinguish bank attachment from wage deductions
For a payment claim against current or savings accounts, the guidance mentions an amount exempt from attachment, beslagvrij bedrag, alongside its explanation of the protected earnings threshold in other situations. These concepts must not be interchanged without checking. Establish which specific measure your bank is implementing. A wage calculation used previously does not automatically explain how much is protected in a bank account. Ask for the applicable rules and facts to be established.
Keep bank statements showing the amount affected and when. Record which essential payments are consequently blocked, without drawing your own legal conclusion from this. Disclose all other collection actions or creditors if there are several. An adviser needs to assess which body took which measure and whether a correction or urgent request for the right amount is being addressed to the right party.
5. Respond before an announced sale
According to the Belastingdienst, attachment of property can ultimately lead to a forced sale. Read the documents for the timing and method of enforcement. The official page advises contacting the tax bailiff concerned before sale when there may be grounds not to proceed. Contact alone does not, however, prove the sale has actually been cancelled. Ask what decision or confirmation exists.
If you dispute ownership, whether attachment is permissible or the power to enforce, have your specific defence assessed immediately. Bring title deeds, purchase receipts and any agreements. Do not sell or move goods on your own initiative to circumvent the measure. The lawyer must first determine the legal route and necessary protection. A substantive disagreement about the assessment can exist alongside this collection issue, but cannot replace it.
6. Coordinate legal and financial next steps
A payment solution, correction of the protection calculation and a defence against enforcement are different tools. Have someone determine which are necessary and which body decides them. A tax lawyer can also assess whether immediate judicial intervention is appropriate. Do not assume that every objection or request automatically suspends enforcement. Ask specifically which action prevents enforcement and what is still merely under investigation.
Where debts are broader, assistance may also be needed to put income and obligations in sustainable order. An appointment with a debt adviser likewise does not mean, without confirmation, that all attachments stop. Record the roles of the advisers involved. Forward every current notice, especially when a new deduction or sale date follows. Otherwise, legal advice based on last month’s letter may miss the present urgency.
7. Fictional example: wage attachment using incorrect personal data
Suppose an employee sees a deduction resulting from a tax claim and thinks the entire tax case must be challenged again. However, the calculation of the protected portion appears to use incorrect information about personal circumstances. The lawfulness of the debt and the correct implementation of the deduction must then be examined separately. One general letter about the old assessment does not answer both questions.
The employee gathers the attachment documents, calculation and payslips and raises the possible data error through the appropriate route. An adviser also considers whether there is an independent defence against collection. This fictional example does not promise complete release. It shows why checking a specific calculation can sometimes be a different first step from reopening discussion of the original tax base.
8. Checklist for urgent advice about attachment
Start the discussion with what is being frozen or withheld today and which date comes next. Then add the debt and deferral history. This lets the adviser assess the measure, protection and substantive dispute in the right order.
- Complete attachment document and notices from the bank, employer or benefits agency.
- Underlying assessment, demand and enforcement order with references and dates.
- Payments, credits, deferral decisions and any earlier agreements.
- Protected earnings threshold calculation or information about the exempt amount and personal circumstances.
- Ownership documents, specific consequences, other creditors and announced sale or enforcement date.
Frequently asked questions
Does the same protection apply to every attachment?
No. The Belastingdienst distinguishes measures, referring among other things to a protected earnings threshold for income and an exempt amount for a payment claim against bank balances. Check the correct type.
Does objecting to the assessment automatically stop attachment?
Do not assume so. The substantive tax dispute and enforcement require separate assessment. Ask what deferral or suspension decision actually exists.
Can an old assessment never lead to attachment again?
That is too absolute. Collection has time limits which relevant events can extend. Have the complete timeline assessed.
Is contacting the bailiff enough to stop a sale?
Contact may be necessary, but ask for clarity about the decision and confirmation. If a sale is disputed, have the appropriate urgent legal step assessed.
