Tax law in the Netherlands. A vergrijpboete concerns an allegation of intent or, where permitted, gross negligence, alongside the tax correction. First check whether the letter proposes a penalty or already imposes it. Explain separately why the tax correction and penalty are wrong. Not every return error supports the same allegation. Ask which specific facts and evidence the Tax Administration relies on. Collect return data and discussions with your adviser. Simply saying the adviser did everything is incomplete. Keep original documents and do not replace missing memories with assumptions. For an imposed penalty, the guidance gives six weeks after the assessment with penalty or penalty decision. Check your document and grounds. Ask for later reasons in a timely objection if needed; a proposal may have another response period. You need not answer questions about the offence, intent or gross negligence; you must be told that right before questioning. Official guidance says tax-due questions must still be answered. This is no general right to ignore information requests. Ask a tax lawyer for help with disputed facts, a large penalty or possible criminal proceedings. Immediately report any FIOD or police invitation. Agree which procedures and deadlines the instruction covers. Read the full article and sources. General information does not replace advice about your own situation.
